On May 11, 2023, Susan Donnelly Murphy secured a defense verdict on behalf of her client, a primary care physician, in a medical malpractice trial, after an eight day jury trial at Norfolk Superior Court. The patient’s estate alleged that the primary care physician failed to refer the patient to a specialist, who would have diagnosed her gastric cancer at an earlier time, and prevented her death. The defense maintained, and presented expert testimony, that the standard of care does not require referral to gastroenterology for a patient with GERD who is well controlled on medication with no alarm symptoms. The defense also presented expert evidence that, due to the histology of this patient’s cancer, earlier diagnosis would not have changed the outcome.
